This Privacy Policy tells you about Resort Gems (ResortGems.com) policies and practices for the collection, use and disclosure of information we collect about you through our sites and services, including the website www.ResortGems.com. VacationView, Inc. is the parent company of and operator of Resort Gems (“ResortGems.com”). By using our sites and services, you agree to the terms of this Privacy Policy and you consent to the processing of information about you as described here.

1. Information we collect

In order to better provide you with our numerous services, we collect information from our users.  We collect Personally Identifiable Information, which is information that lets us know the specifics of who you are. We also collect Non-Personally Identifiable information that does not by itself identify a specific individual. Below we describe this information in more detail.

a. Personally Identifiable Information

When you engage in certain activities with ResortGems.com, such as registering for a membership, ordering a product or service, submitting content and/or posting content in discussion forums or other public areas, entering a contest or sweepstakes, filling out a survey, or sending us feedback, we may ask you to provide certain information about yourself by filling out and submitting an online form. Providing information is purely optional on your part; however, not all features and services (such as, responding to your inquiries) would be available to you if you elect not to provide information.

b. We have two levels of Registration.

There are two levels of registration on ResortGems.com. The first is simple registration, which is required to create a rental listing. For simple registration we ask you for the following information:

• Vacation property information (specific resort/property, dated booked, room type, # of points)
• Email address
• Telephone number
• Such other information that we may request from you on an applicable registration or other form on ResortGems.com.

The second level is full registration, which is required to enter into and complete a rental. For full registration we ask you for the following information:

• All simple registration information (telephone number is required)
• Name and physical shipping, contact and payment addresses
• Login password
• Such additional information that we may request from time to time at registration or on one of our rental forms.

c. Information we collect when you use our sites and services.

We may collect information about the way you interact with our sites, services, content and advertising, transact with us including (i) computer, browser and connection information, (i) statistics on page views, traffic to and from our sites, ad data, IP address and standard web log information, (ii) your transactions with us, such as, when you make a purchase, submit a form and download applications from us; and (iv) when you contact us for help.

We may obtain information from or about you in other ways. For example, we may verify user information with a service provider or combine your information with information we collect from other companies. Also, you may send us correspondence, testimonials, photos, blogs, writings, customer satisfaction surveys or customer service communications.

c. Non-Personally Identifiable Information.

We may also collect, or our third-party ad server and/or content server may collect, certain Non-Personally Identifiable Information. This information is ultimately stored in the form of store categories, and, in some cases, specific URLs. We use your IP address to diagnose problems with our servers, software, to administer our Site, and to gather demographic information. Our third-party ad servers will also provide us with summary, but not individual, reports that will tell us how many ads were presented and clicked upon at our Site.

2. How we use information

Our primary purpose in collecting personal information is to provide you with a safe, efficient and customized experience. We may use the information we collect to:

• provide the services and customer support you request,
• resolve disputes, collect fees and troubleshoot problems,
• prevent potentially prohibited or illegal activities and enforce our policies,
• measure, statistically analyze, customize, enhance and improve our sites, services, marketing, promotions and advertising,
• tell you about our services and those of our corporate family, service updates,
• provide offers and advertising that may be of interest of you based on your communication preferences and use of our services,
• provide you with important notices about our services, terms and privacy policy. and
• compare information for accuracy and verify it with third parties.

3. We do Not Sell Your Information

We do not sell, rental, or rent your Personally Identifiable Information to others. We rely on affiliates and certain third party services under contract with us to help us provide certain ResortGems.com services to you. Our service partners and we use your Personally Identifiable Information to operate our sites and to deliver their services. For example, we must release your credit card information to the card-issuing bank to confirm payment for products and services purchased on this Site; release your address information to the delivery service to deliver products that you ordered; and provide order information to third parties that help us provide customer service.

If such service providers have access to Personally Identifiable Information, they are required to protect this information in a manner that is consistent with this Privacy Policy by, for example, not using the information for any purpose other than to carry out the services they are performing for the Site and the fulfillment of orders made by you.

Occasionally, we may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. We will disclose Personally Identifiable Information upon receipt of a court order or subpoena or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

4. You Agree that We May Share Your Information for Your Transactions

You understand and consent that we must share information between our customers that allow them to complete a rental. ResortGems.com only shares name and a registration confirmation that each rental provides. As such, ResortGems.com does not control what is contained within the registration confirmation so it may contain information such as name, like name, shipping address and other information.

We may also share your personal information with:

• Members of the VacationView Inc. corporate family (such as, VacationView.com) to provide joint content and services (like registration, transactions and customer support), to help detect and prevent potentially illegal acts and violations of our policies, and to guide decisions about their products, services and communications. Members of our corporate family will use this information to send you marketing communications only if you've requested their services.
• Service providers under contract who help with our business operations (such as credit card processing, real-time hotel booking, delivery services or bill collection).
• Co-brand partners for certain sites, events or listings. When we identify a partner for a co-branded site, event or listing, we may share contact information and transaction data (excluding credit card numbers) with that partner. We will treat the information you provide according to the terms of this Privacy Policy. You can refer to a partner’s privacy policy for information on how they will handle your information.
• Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
• Other business entities, should we plan to merge with or be acquired by that business entity or sell assets. Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information will be used contrary to this policy, you will receive prior notice.

5. Cookies and web beacons

Cookies are a standard Internet technology, and many major web sites use them to provide useful features for their members. Cookies to allow us to improve the quality of our service, store user preferences, store and retrieve login information on a user's system, and to personalize content and offers of interest to our users. We also allow our service providers to collect non-personally identifiable information by placing cookies on the Site that will track certain performance of our services, such as, web site traffic, click-throughs, etc., in order to assist us and our service providers in better understanding the interests of our users and to better serve those interests. When you first use our sites and services, ResortGems.com may send a cookie to your computer that identifies you as a unique user. We may use session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to store your preferences, identify you and maintain your signed-in status, and provide you with a more personal and interactive experience. You can set your browser to refuse cookies or delete persistent cookies by following your browser s help instructions. If you choose to disable cookies, some of our services may not work properly and you may not be able to rental.

We work with companies who may use cookies and web beacons to collect anonymous information that helps us measure and improve our content and advertising effectiveness. We use the services of Google, who help us measure our site, and collects & analyzes anonymous usage and volume statistical information from our users. We may share some anonymous, aggregated demographic information (like ages or zip codes) with some of our partners, but we do not share any personally identifiable information. We may add other advertising network services from time to time and, therefore, we urge you to review this Privacy Policy for updates and the options that you may have to opt out of such advertising network’s program in this Section 5.

6. Accessing and changing personal information

You can access and change your account information in My Account www.ResortGems.com/login. There, you can change your resort/property information, address, telephone number, email address, password, credit card information and privacy and communications preferences.

We may communicate with you at various times, with administrative emails or phone calls, about transactions and service announcements, customer service responses, and promotional emails like special offers, newsletters and updates. You can choose to stop receiving promotional emails at any time simply by changing your preferences, unsubscribing on the website, or using an email's unsubscribe function. You may not opt out of receiving administrative messages or customer service responses.

If you choose to use our referral services, we ask you for your friend’s name and email address. We will automatically send your friend a copy of the email. ResortGems.com or our service providers store this information for the sole purpose of sending this one-time email. Your friend may contact us at customerservice@resortgems.com to request that we remove this information from our database.

7. Security

Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

8. Third Parties

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you when you use ResortGems.com. If you disclose your information to others, whether they are listers or renters on our sites or other sites throughout the internet (including the ones we link to), different rules may apply to their use or disclosure of the information you disclose to them. ResortGems.com does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your personal information to others. We may present links in a format that enables us to keep track of whether these links have been followed. We are not responsible for the privacy policies, practices or contents of any third party websites. Please refer to the privacy policies of such third party websites for information on what kinds of personally identifiable information such websites collect and their respective privacy practices, terms, and conditions.

9. Acquisition

We reserve the right to transfer your personal information in the event of a transfer of ownership of ResortGems.com, such as acquisition by or merger with another company. If an acquiring company should plan to materially change this privacy policy, we will notify you beforehand.

10. Privacy Policy Updates

We may change this Privacy Policy at any time. We made provide notice of such changes issuing an e-mail to the e-mail address listed by registered users and/or by posting a notice about our revised Privacy Policy on the Site. You agree to assume the responsibility to (a) visit this page periodically to review any such changes and to (b) maintain a valid e-mail address as a registered user. By accessing and continuing to use the Site after we post notice of any changes, you signify your consent and agreement to the updated Privacy Policy. 

11. ResortGems.com is Not for Minors.

You must be at least 18 years old to have our permission to use this Site. Our policy is that we do not knowingly collect, use, or disclose Personally Identifiable Information about visitors that are under 18 years of age.
